Frank T. Koserowski was admitted to the
bar in 1970. After serving a judicial clerkship with the Honorable
August W. Heckman, J.S.C. (1970-1971), he associated with the firm
of Rose, Poley, Bromley & Landers in Hackensack, New Jersey,
where he specialized in a litigation practice which emphasized trial
matters (matrimonial, equity, negligence, appellate work) and real
estate matters.
In 1978, after having established his own private practice, he joined
the Hudson County Law Department as a part time Assistant County
Counsel. From 1978 to 1986, Mr. Koserowski represented the County
of Hudson in high impact, high visibility disputes with other governmental
and/or political entities in various forums including the courts,
Freeholder Boards, the legislature, etc.
Mr. Koserowski also served as counsel to the Hudson County Employees
Pension Commission and assisted in the initiation and preparation
of legislation furthering the interests of Hudson County in the
State Legislature, often appearing and testifying before appropriate
legislative committees.
During 1978 and 1979, Mr. Koserowski participated in the formulation
and final adoption of the Hudson County Solid Waste Management Plan,
including the presentation of same to the County Freeholders, local
municipal officials, the New Jersey Department of Environmental
Protection, etc.
Following the adoption of the Hudson County Plan, Mr. Koserowski
participated in the recommendation and eventual reactivation of
the Hudson County Improvement Authority and its designation as the
implementing agency of the County Solid Waste Management Plan. He
accepted the position of General Counsel to the Authority in 1986,
and continued in that capacity until May of 1991.
In the course of his representation of the Hudson County Improvement
Authority, Mr. Koserowski directed the successful negotiation of
a vendor service agreement, site acquisitions, numerous financings,
and various regulatory submissions to the New Jersey Department
of Environmental Protection, the Local Finance Board and the Board
of Public Utilities. He has also participated in the formulation
and adoption of the Hudson County Recycling Plan prior to the enactment
of the Statewide Mandatory Source Separation and Recycling Act in
1988. He directed the successful negotiations of a long term acquisition
of out-of-state landfill capacity on behalf of the Hudson County
Improvement Authority with attendant Transportation and Interdistrict
Agreements. He has successfully negotiated consultant contracts,
represented the Hudson County Improvement Authority before the New
Jersey Department of Environmental Protection on various environmental
and permitting issues and appeared before the State, County and
local agencies to offer recommendations concerning the planning
and implementation of the Hudson County Solid Waste System.
Mr. Koserowski's representation of private companies has focused
on permitting and regulatory activities which he has rendered on
behalf of large scale hauling and recycling companies. These activities
have related to the acquisition of materials recovery facilities,
transfer stations, recycling centers and paper mills.
In addition, Mr. Koserowski has either litigated or has directed
the litigation of issues relating to solid waste disposal, rate
averaging, compliance with the Open Public Meetings Act, tax matters,
etc. with the New Jersey Department of Environmental Protection,
the New Jersey Board of Public Utilities, the Hackensack Meadowlands
Development Commission, etc.
From 1981 until the present, Mr. Koserowski has also represented
various health care providers including home health agencies and
other nonprofit entities in general corporate and employment related
matters. These representations have also required the resolution
of more technical issues including the successful completion of
multimillion dollar Medicare reimbursement disputes with the Health
Care Finance Administration, participation in the New Jersey Certificate
of Need process, the resolution of licensing issues with the New
Jersey Department of Health and the negotiation of managed care
and other cooperative arrangements between health care providers.
The representations referenced above have often necessitated efforts
in the governmental relations area including interaction with members
of Congress, state and local legislators. In this context, Mr. Koserowski
has appeared before and/or lobbied members of the Senate Finance
Committee, the House Energy and Commerce Committee, the House Ways
and Means Committee, as well as Committees of the New Jersey Legislature
and the local freeholder boards. Quite often, achieving the clients'
legislative goals has also required coordination and cooperation
with national groups such as the National Association of Home Care,
the American Hospital Association, the American Forestry and Paper
Association, etc.
More recently Mr. koserowski has focused on activities
relating to the cleanup and development of "Brownfield Sites"
in primarily urban areas. He was a founding member of the Gateway
USA initiative which sought to develop a world-class Trade and
Exposition Facility at the Bayonne Military Ocean Terminal site,
and is currently representing clients pursuing the development of
hotels, mixed use and commercial projects on formerly contaminated
sites in Hudson County. He is involved in several projects which
seek to optimize the beneficial use of various recyclable fill materials
approved by the NJ D.E.P. in the closure of existing landfills and/or
remediation and development of previously problematic sites.
Mr. Koserowski is a graduate of the University of Notre Dame (A.B.
1967) and the St. Louis University School of Law (J.D. 1970). He
is currently a member of the Hudson County Bar Association, the
National Health Lawyers Association, and the Home Health Assembly
of New Jersey.
After her admission to the New Jersey Bar in 1977,
Kathleen M. Grant joined the Hudson County Law Department as a full
time Assistant County Counsel, shifting to part time in 1981. This
status allowed Ms. Grant to establish a private practice with the
late Francis P. Morley. Esq., then Hudson County Counsel, and Frank
T. Koserowski, Esq.
Ms. Grant has developed a road range of experience
representing the County of Hudson in Employee, Tort and Contract
Law, together with extensive experience before the Office of Administrative
Law, as well as New Jersey and Federal Courts. The representative
sample list characterizes Ms. Grant's practice of law while serving
Hudson County.
When Ms. Grant initially joined the Hudson County
Counsel's Office, the County of Hudson was actively involved in
significant cases interpreting the impact of the optional County
Charter Law on automonous agencies as well as termination procedures
for high ranking "at will" County employees. In addition,
Ms. Grant participated in the litigation which developed guidelines
for those applications by prosecutors for increases from the County
for their budgets.
Ms. Grant has defended high ranking officials
and department heads including the County Executive, Superintendent
of Elections and the Department of Human Resources against the charges
of unlawful employee termination. In addition, monitoring of potential
discrimination law suits with appropriate and thorough responses
to the New Jersey Division of Civil Rights or the Equal Employment
Opportunity Commission investigations resulted in no cause decisions.
Litigation when necessary occurred on an administrative level at
the Equal Employment Opportunity Commission, as well as in the New
Jersey Superior Court and in the New Jersey District Court.
Ms. Grant represented both public and private
entities in multimillion dollar litigation dealing with construction
disputes and Medicare/Medicaid reimbursement issues.
She has also negotiated and prepared entities
in multimillion dollar health service contracts between public and
private entities.
Ms. Grant handles a great amount of real estate
transactions, both residential and commercial, representing buyers
and sellers and those wishing to refinance.
She is also experienced in general litigation
matters dealing with various issues such as contracts, negligence,
wills and estates, etc.
Ms. Grant is a graduate of Fordham University
where she earned a Bachelor's Degree in 1969 and a Master's Degree
in 1970. She graduated from Seton Hall School of Law in 1976, and
she is currently a member of the Hudson County Bar Association.
